These are the complete membership terms for ENERGY Fitness, reproduced word for word as they appear in the membership agreement you sign.

Membership

  1. Unless otherwise specified, the membership runs from the day you enrol. On enrolment you are charged a training fee for the remaining days of the current month. For some memberships there is also an enrolment fee (specified in the membership agreement).
  2. When a training agreement with a binding period is entered into, the binding period runs from the same date the contract is signed. Contracts with a binding period cannot be terminated before the binding period has expired. On expiry of the binding period, the contract is automatically extended by 1 month at a time. At the same time, the contract is adjusted to an ordinary running basic membership with the associated terms and at the price applicable at any given time.
  3. An agreement to interrupt a binding period is approved only on presentation of a medical certificate from a doctor showing that the member is not physically able to complete the membership through the binding period. Any outstanding amounts fall due in full. On termination during the binding period, the customer will be charged a short-term supplement of NOK 800. Any sick note or medical certificate has no retroactive effect, it applies from the date it is received by the fitness centre – both for freezing and for termination.
  4. On termination of a membership, the membership ends at the end of the first full calendar month following the month of termination, with one month's paid notice period at the ordinary price. It is not permitted to freeze a membership during the notice period. The member cannot claim compensation or a refund of the training fee if the centre has to be kept closed owing to unforeseen interruptions in operations (‘force majeure’).
  5. For memberships that end in periods that are payment-free or where a time-limited discount has been given, point 4 also applies – with one month's paid notice period at the ordinary price after the discounted period has ended, unless otherwise specified.

Payment terms, direct debit and invoice

  1. Payment of the membership fee is made by direct debit. Once the direct debit mandate has been set up in the member's bank and ENERGY Fitness has received the mandate in its membership system, the first direct debit charge can be made. Until the mandate has been received, the instalment is paid by manual invoice sent electronically. An invoice fee then applies in addition to the instalment amount until direct debit has been set up. The agreed instalment amount is then charged from the member's account in arrears on the 20th of each month, regardless of how often the member trains, until the member terminates the membership.
  2. Failure to attend does not exempt the member from meeting the payment terms.
  3. In the event of a change of bank account, the member must ensure that the bank charges the agreed monthly amount from the correct account.

Administration of the membership

  1. Administration of the membership, including freezing, termination and changes to personal information – shall take place exclusively via the Membro membership app.
  2. If you wish to end a freeze period before the freeze expires, this must be done by email to hei@energyfitness.no.
  3. Freezing a membership costs NOK 33 per month and must be registered the month before the desired freeze period starts. You can freeze for as many months as you wish. The membership continues after the freeze ends without further notice. When a contract with a binding period is frozen, the freeze period is added to the binding period. The membership cannot be terminated while it is frozen, if you have a payment-free month or where a time-limited discount has been given. To register a termination during the freeze period, the member must lift the freeze period before termination can be done in the Membro app. ENERGY will charge the membership fee according to type of membership in the month of termination.
  4. You are responsible for keeping your personal information up to date at all times. You have access to change it in Membro. ENERGY Fitness disclaims liability for errors in information you have registered yourself.

Default

  1. The member is responsible for having correct payment details at all times. The member is responsible for ensuring that payment goes as agreed and for notifying the centre of any missing or incorrect direct debit charge. In the event of non-payment by the agreed due date, the claim is sent to a third party for further collection. The rules that apply at any given time under the provisions of the Debt Collection Act then take effect. In the event of more than 1 missed payment of the membership fee, access to the centre is blocked. If claims remain unpaid after a payment notice, the remaining contract value falls due for payment in full.
  2. A membership created on the basis of incorrect personal information may be terminated with immediate effect. Payment for periods in which the membership has been active and the service has been used is not refunded.

Access to the centre

  1. After enrolment you download the Membro app. The app works as your digital membership card and gives you access to the centre from your phone. Alternatively, you can buy an access fob from the vending machine at the centre. Read more at energyfitness.no/inngang.
  2. Your membership is personal, and it is not permitted to let others in on your own membership, not even other members! In the event of misuse, access to the centre is blocked automatically for two weeks without a refund of the membership fee, and a fee of NOK 900 is added and charged at the next due date. Unsettled claims will be pursued legally. If misuse of your membership or key fob is suspected, it must be reported to EFC as soon as possible so that it can be deactivated or stopped.
  3. A branch may at times be closed or have a reduced offering in connection with, for example, public holidays, maintenance or other matters falling under force majeure. A reduced training offering gives no right to a refund of the membership fee.

Training at the centre

  1. By signing the membership contract, the person concerned declares that he or she is physically fit to take part in the training activities at the centre. Training at ENERGY Fitness is at your own risk, and you are responsible for the belongings you bring to the centre. ENERGY Fitness disclaims liability for loss of or damage to persons or objects arising during or as a result of the undersigned's stay at the fitness centre, including loss of and damage to clothing and personal belongings, unless the centre has acted negligently.
  2. As a member you are obliged to familiarise yourself with and follow the centre rules that apply at any given time, which are found on energyfitness.no and posted at the centre. In the event of a material breach of these, or a breach of the guidelines that apply at any given time for the use of ENERGY’s facilities, ENERGY may choose to terminate the membership. Any outstanding membership fee is not refunded
  3. If a member causes damage to the centre or to equipment, that person is liable to compensate the injured party's financial loss, cf. section 4-1.
  4. ENERGY Fitness takes safety seriously. We have drawn up fire and safety procedures for each individual centre. These are posted at all centres. You have an independent responsibility to familiarise yourself with where the emergency exits are, and with the safety procedures relating to fire.

ENERGY Fitness' rights

  1. By signing the contract, the member confirms that voluntary consent is given for the premises to be video monitored, and that the consent is given pursuant to the Personal Data Act section 2 no. 7. The member also consents to all recordings being stored for 14 days, and to the purpose of the monitoring being the prevention of crime and misuse of ENERGY's facilities and equipment. The member is aware that these recordings can be viewed only by the general manager, and that recordings will be used only in accordance with the purpose of the monitoring.
  2. ENERGY may, without prior notice, index-adjust the prices in line with the development in the consumer price index over the last 12 months, as determined by Statistics Norway. Other price changes require 30 days' notice by email or SMS.
  3. The contract may be transferred to a third party.
  4. ENERGY is not liable for any impediment to or limitation of training opportunities due to circumstances outside ENERGY's control, and which ENERGY could not have foreseen or avoided the consequences of (Force Majeure).
  5. ENERGY reserves the right to change the applicable terms of membership. See the updated membership terms at www.energyfitness.no.
  6. Disputes between the member and ENERGY shall be sought resolved amicably. If this does not succeed, either party may bring the dispute before the ordinary courts.
